News coverage continues to indicate that voters are tired with business as usual in Washington and are gravitating towards the smaller, less intrusive government message championed by Republican candidates. In rural Arizona, voters are resonating with Dr. Paul Gosar’s plan to create jobs and get the economy back on track. She does not support SB 1070 and refuses to donate the $10,000 she has accepted from SEIU, the leader of the boycott against Arizona. She will do or say anything on the campaign trail to cover up her record, but the facts don’t lie.
Failed “Stimulus” Bill FACT: In February 2009, Rep. Ann Kirkpatrick voted for final passage of the $787 billion stimulus package.
Fiscal Irresponsibility FACT: In April 2009, Kirkpatrick voted for the House version of the fiscal year 2010 budget.
Taxpayer Funded Earmarks FACT: In less than two years since taking office, Kirkpatrick has requested nearly $100 million in taxpayer funded earmarks.

Kirkpatrick’s Abysmal Record FACT: Since Ann Kirkpatrick has been in Congress, Arizona’s unemployment rate has increased 20% and more than 30,000 jobs have been lost. -30- Paid for By Paul Gosar for Congress TOM HORNE FORSEES NINTH CIRCUIT PARTIALLY OVERRULING LOWER COURT ON S.B. 1070HORNE FORSEES NINTH CIRCUIT PARTIALLY OVERRULING LOWER COURT ON S.B. 1070 PHOENIX – Republican Attorney General nominee Tom Horne, who attended today's U.S. Ninth Circuit Court of Appeals hearing regarding S.B. 1070, believes at least part of the lower court ruling vacating portions of the law will be overruled. "Before these arguments began, there was much discussion about the three judges, who is on the left, the right and in the middle," Horne noted. "Regardless of those considerations, I believe the three judges will unanimously overturn Judge Susan Bolton's earlier decisions on S.B. 1070 in regards to Sections 2 and 6, but not Sections 3 and 5." Horne explained, "On the merits of Section 2, which is the language that requires local law enforcement to make inquiries of Immigration and Customs Enforcement, Judge Bolton ruled that such language was an undue burden on ICE. But it is clear to me this panel will unanimously overrule her and will rule that the federal government is obligated under statute to respond to inquiries of local law enforcement." He added, "Section 6 deals with warrantless arrest of a suspected illegal who has committed a crime that is a 'removable offense.' The Ninth Circuit panel believes this is a law that could be applied in a way that is unconstitutional, but could still be applied in manner that is legal. The court challenge in this instance is called a 'facial challenge' which means if there is any way to enforce the law legally, the challenge should fail. For that reason, I believe the Court will unanimously overrule Judge Bolton on Section 6." Horne continued, "In regards to Section 3, which is the documentation requirement, the judges said Arizona may not add to the federal law that requires legal aliens to carry documentation of their immigration status. If the lower court ruling is upheld, the state would argue before the U.S. Supreme Court that the state and federal requirements are the same." Horne concludes, "With respect to Section 5, which concerns employment of illegal immigrants, the Court will likely rule against Arizona because the Ninth Circuit is bound by an earlier ruling by another three judge panel from the Ninth Circuit. There are very serious crimes associated with this failure, including human smuggling, drug trafficking and other activities involving coyotes in Arizona, as acknowledged by Judge Bolton. Arizona is on the front line in a fight against crime that is spilling over the international border. As noted in the court record, the federal government has essentially had to cede a vast territory inside the State of Arizona to the drug runners and human smugglers. “With a federal government that cannot or will not do its job, Arizona determined that Arizona law enforcement officers would assist in the enforcement of federal immigration laws to the full extent permitted by federal law. The District Court applied the wrong legal standard of review and issued a preliminary injunction that preserves the status quo – a status quo that is unacceptable to the people lawfully present in Arizona, many whose lives are affected on a daily basis. Although the judges asked challenging questions of both sides during this morning’s hearing, we are hopeful that after carefully considering the arguments, the Ninth Circuit will lift the stay and allow SB 1070 to be enforced.
